Symposium of Nawazil Fiqhiyyah Discusses New Issues in Hajj and Umrah

The College of Shari`ah and Islamic Studies, at Umm Al-Qura University, organizes the second Symposium of Nawazil Fiqhiyyah (new jurisprudential issues that were not discussed in legal Fiqh manuals). The symposium will last for two days. Its first session discussed a number of new issues related to Hajj, Umrah, the Sacred Mosque, and giving preponderance to scholars' opinions in their legal rulings by referring to the opinions of the Council of Senior Scholars.

The Vice President for Female Student Affairs, Dr. Sarah Al-Khuli, praised the academic cultural diversity in the activities of this university edifice, both in the organization of the symposiums and other activities that contribute in spreading religious awareness among the affiliates of the university. This activity is organized by a number of supervising committees that exploit all their available potentials to promote the university. The Vice Dean of the College of Shari`ah and Islamic Studies, Prof. Nurah Al-Mahmadi, asserted the keenness of the college to teach a course entitled, 'Contemporary Legal Issues', to postgraduate students to qualify them to be able to clarify the rulings of new legal issues in Islamic Law.

The General Supervisor of the Nawazil Fiqhiyyah Exhibition and the Professor of Jurisprudence at Umm Al-Qura University, Prof. Afnan Al-Tilmisani, pointed out that the geographical location of the university makes it worthy of conducting such activities that pay great attention to the sacredness of the place by studying unprecedented legal issues related to the sacred place, relying on detailed and accurate research studies that are based on the sayings of well-versed specialists. She also pointed out the necessity of encountering false conceptions by explaining how they contradict the Shari`ah.

During the first session, the female researchers dealt with new religious issues related to Hajj and Umrah. The presented working papers covered topics such as the conditions of issuing permits for Hajj and Umrah, and the effect of using the principle of legal isthisan in examining such a case. Moreover, the study observes the causes of issuing permits for pilgrims. Such permits will help organizing the number of visitors to Makkah Al-Mukarramah to enable them to perform ritual in an organized way that facilitates offering them the necessary services during the period of their stay.

Female researchers tackled the issues of woman's performance of Hajj without a mahram (un-marriageable kin) by traveling on modern means of transportation. They also tackled the project of widening the Jamarat basins, building on the mountainside of Mina to inform people about its boundaries, and scholars allowing this due to the public benefits involved for the Muslims.

The academic papers of the second session dealt with new unprecedented issues related to the Sacred Mosque by mentioning the views allowing and prohibiting performing prayer behind the Imam of the Sacred Mosque while in the hotels of the central area that do not overlook the Haram. It also dealt with the legal view on ascending Safa and Marwah for women in the state of Ihram (ritual state for Hajj and Umrah). Moreover, they tackled the new issues that resulted from the modern communication revolution, such as broadcasting legal Ruqyah (prayers for protection) through satellite channels, whether recorded or live, over the telephone or by joining groups of people performing Ruqyah.
