20260803330This study examines cash waqf and analyzes selected practical applications, using the University of Jordan Waqf as a case study. It aims to clarify the Islamic legal ruling on endowing monetary funds. Muslim jurists unanimously agree on the permissibility of establishing waqf from immovable assets; however, they differ regarding movable and consumable assets whose substance does not remain intact, including money, as its principal may be depleted through investment. The researcher adopts the view that cash waqf is permissible, subject to specific controls, including investing the endowed funds in designated sectors or fields and allocating the resulting returns to the poor and needy or to students of knowledge, thereby serving the interests of society. This view is considered the preferred position in the study. The study also examines several practical applications of cash waqf, particularly the University of Jordan Waqf.
The study employs the inductive approach to examine the foundations, objectives, legal rulings, and principles governing waqf assets and their development. It also adopts the analytical approach to analyze relevant legal texts from the Holy Qur’an, the Prophetic Sunnah, and Islamic jurisprudential sources in order to derive the rulings related to the subject.
The study recommends encouraging researchers to monitor existing cash waqf projects and scientifically assess their impacts, particularly their contribution to addressing poverty and social needs, expanding educational opportunities, and promoting knowledge, thereby supporting sustainable development and serving society
