Ibn al-Mutahhar al-Hilli's Influence by the Mu'tazilites in the Principles of Ju-risprudence - The Chapter of Legal Ruling as an Example

Abstract

The research aims to refute the claim that Ibn al-Mutahhar al-Hilli was influenced by Ahl al-Sunnah in his foundational choices, and to prove the influence of Ibn al-Mutahhar al-Hilli by the Mu'tazilites in his foundational opinions. In this research, the inductive, comparative analytical, and descriptive methodologies were used. The conclusion of the re-search reached several important results, including: that Ibn al-Mutahhar al-Hilli agreed with the Mu'tazilites on all the issues of the research, to the extent that he even contradicts the Twelver Imamiyah as in the issue of permissible coer-cion. Additionally, it was found that when there is disagreement among the Mu'tazilites, Ibn al-Mutahhar al-Hilli tends to lean towards the opinions of Abu al-Husayn al-Basri, as indicated by the study of the research issues where there was a convergence between Ibn al-Mutahhar al-Hilli and the Mu'tazilites on the reasons for disagreement. Furthermore, Ibn al-Mutahhar al-Hilli's interest in the disagreements between the Mu'tazilites and the Ash'arites in foundational issues was also evident. In conclusion, the research recommends paying attention to tracking the foundational articles of the prominent figures of the opposing sects to Ahl al-Sunnah wal Jama'ah, to confirm what scholars have established, both ancient and modern, that these opposing sects take from each other and are influenced by each other.
