Abstract
The title of this research comes within the topics under personal status laws،one of the most important branches of private law. In this research, an explanation of some of the provisions of custody by examining the words of the jurists،and then comparing what I found from the words of the jurists with the Saudi personal status system issued on 6/8/1443 AH. Taking care to mention the traditional jurisprudential trends on the one hand, and practical realism on the other hand about dealing with this issue،taking care of realistic evidence and judicial applications from the courts of the Kingdom of Saudi Arabia, and then concluding with the most correct and correct in this issue with its evidence.
