Royal Decree Number: M/55 dated: 23/10/1409H

In the name of the Custodian of the Two Holy Mosques, the King, we, Abdullah bin Abdulaziz Aal Saud

Viceroy of the Kingdom of Saudi Arabia

After reviewing the royal decree number (A/412) dated 17/10/1409H

And after reviewing the nineteenth and the twentieth articles of the Council of Ministers’ system issued in the royal decree number (28) dated 22/10/1377H.

And after reviewing the decree of the Council of Ministers number (171) dated 11/09/1409H.


We decreed the following:

First: Approve the regulation of the National Center for Documents and Archives as attached.

Second: His Highness the Deputy Prime Minister and the Ministers, each in his own hands, to implement this decree.

Indeed, the Council of Ministers

After reviewing the transaction attached, that is sent by the Office of the Presidency of the Council of Ministers number 1/21810 dated 03/12/1404H, including the letter of the Minister of Finance and National Economy number 5938/404 dated 15/11/1404H, concerning the draft of the National Center for Archives’ regulation.

And after reviewing the memorandum of the Division of Experts number 155 dated 15/10/1406H, and its memo number 42 dated 13/03/1407H.

And after reviewing the report prepared in the Division of Experts number 119 dated 29/06/1409.

And after reviewing the recommendation of the General Committee number 96 dated 05/09/1409H.

The following is decreed:

Approve the regulation of the National Center for Documents and Archives as attached.

A royal decree draft has been prepared in this regard. Attached is its form.

The National Council for Documents and Archives Regulation

 

Article One:

The names given in this regulation shall have the same indications as in Article 1 of the Documents and Archives Regulation.

Article Two:

Under this regulation, a center called The National Center for Documents and Archives, administratively linked to the Chief of the Cabinet of the Council of Ministers, shall be established.

Article Three:

The purpose of the Center is to establish the Regulation of Documents and Archives that is the subject of the implementation, and in doing so, it shall take all required means and measures to carry out this task, such as:

  • Prepare the executive regulations required for the regulation of the documents and archives, and implement them after having them approved.
  • Prepare a unified documents and archives classification guide, and a comprehensive coding guide for state agencies.
  • Collect, index, classify, code, preserve, maintain and regulate the circulation of the documents and archives as per the system, the executive regulations of the documents and archives, and the plans of classification and coding.
  • Supervise and technically follow-up on the preservation processes in the government agencies, and protect the documents and archives.
  • Prepare the administrative organization and the technical and administrative procedures necessary for the Center’s work, and implement them after having them approved.
  1. Provide data, information on the documents and archives for the beneficiaries as per the Center’s regulations.
  2. Collect the systems, regulations, instructions, agreements, and conventions as per the system of the documents and archives, and its regulations.
  • Achieve complete coordination and integration with agencies concerned with the documents and archives in the Kingdom, and exchange expertise and information with them.
  • Achieve collaboration in the field of documents and archives with the international specialized agencies, through:
  1. Participate in regional and international bodies and organizations in the field of documents and archives, attend seminars, conferences and specialized scientific lectures, and prepare related researches.
  2. Exchange information with the national centers for documents and archives in the world.
  • Work with the specialized authorities to find national qualified calibers to work in the field of documents and archives, and take all required measures to achieve this.
  • Supervise the destruction of archives and documents that are decided to be destructed under the relevant regulations.

Article Four:

The Center shall have a Commission concerned with the following:

  • Draw the general policy of the center and follow up on its implementation.
  • Suggest rules, regulations and procedures as it deems appropriate for achieving the best implementation of the documents and archives system.
  • Issue executive regulations for the documents and archives system.
  • Approve the plans, programs, and projects proposed by the Center’s management.

Article Five:

The Commission shall be composed of:

  • The Head of the Cabinet of the Presidency of the Council of Minister, as Chairman.
  • The Secretary General of the Council of Ministers, as a Member.
  • The Head of the Division of Experts at the Council of Ministers, as a Member.
  • The Director General of the Center, as a Member.

Three members are to be selected by a summons for three years renewable for a similar period.

Article Six:

The Commission shall meet under the chairmanship of its chairman, or its deputy from the members. And the meeting is not considered to be regular, except with the presence of the majority of the members.

Article Seven:

The decisions of the Commission shall be made by a majority vote of the present members. When the votes are equal, the Chairman’s vote is considered a casting vote.

Article Eight:

The Director General of the Center shall be appointed at the fifteenth rank.

Article Nine:

The Director General shall manage the center and its affairs, and in order to do so he is entitled to:

  • Propose the plans, programs, and projects of the center, and follow up on their implementation after approval.
  • Propose the executive regulations for this system.
  • Propose appropriate regulations for documents and archives in accordance with the technical and administrative development.
  • Propose any suggestions he deems appropriate for the proper functioning of the work.
  • Represent the center in its relations with other entities.
  • Implement the decisions of the commission.
  • Submit regular reports on the progress and achievements of the work of the center to the commission.

 

Article Ten:

The center shall have its own budget.

 

Article Eleven:

This regulation shall cancel any other provisions relating to documents and archives.

 

Article Twelve:

This regulation shall be published in the official gazette.
